Petition under Article 226 of the Constitution of India praying that in the

circumstances stated in the affidavit filed therewith, the High Court may be

pleased to ay be pleased to issue a Writ order or orders more particularly one

in the nature of the a writ of Mandamus against the Respondents by declaring

that the action of the respondents in restricting me from running of the canteen

in APSRTC bus station, Ongole, 24hrs x 7days as arbitrary, illegal, viod ab-

initio besides violation of the mandate of the AP Shops and establishments

Act, Articles 19 and 21 of the Constitution of India and principles of natural

justice and consequently to direct the Respondents no to interfere with the

running of my hotel business every day and to pass such

The Court made the following ORDER:

The writ petition, under Article 226 of the Constitution of India, is filed

seeking the following relief:

“to issue a Writ order or orders more particularly one in the nature of the

a writ of Mandamus against the Respondents by declaring that the

action of the respondents in restricting me from running of the canteen

in APSRTC bus station, Ongole, 24hrs x 7days as arbitrary, illegal, and

besides violation of the mandate of the AP Shops and establishments

Act, Articles 19 and 21 of the Constitution of India and principles of

natural justice and consequently to direct the Respondents no to

interfere with the running of my hotel business every day…”

2. Heard learned counsel for the petitioner and learned Assistant

Government Pleader for Home appearing for respondents.

3. The learned counsel for the petitioner submits that the petitioner is

running a canteen in APSRTC Bus Station, Ongole, and that the said shop

was allotted vide order dated 21.12.2024 by the APSRTC. It is submitted that

the 3rd respondent is interfering with the petitioner’s business, which is

affecting the Fundamental Right to life. It is also submitted that the petitioner

has validly obtained the lease from APSRTC to run the canteen. Further, it is

submitted that the petitioner started running the canteen from 07.02.2025. It is

further submitted that the 3rd respondentis causing hindrance to the petitioner

in running the canteen.

4. The learned Assistant Government Pleader appearing for respondent

Nos.1 to 3 on written instructions submits that the petitioner’s shop is on the

entrance to the main road, and that passengers face many problems during

night time due to boozers and chain snatchers, and that keeping the shop

open at night will cause law and order problems. It is also stated that there is

no proper parking place for the petitioner’s shop. It is further submitted that

keeping the shop open after odd hours is causing traffic issues, and hence,

prays for dismissal.

5. Considering the submissions of the learned counsel for the petitioner

and the learned Assistant Government Pleader, there shall be a direction to

the 3rd respondent not to disturb the petitioner’s business without following

the due process of law, and the 3rd respondent may also take appropriate

steps for regulating the traffic
