that in the circumstances stated in the affidavit filed therewith, the

High Court may be pleased toprayed to issue Writ, Order or

Direction more particularly one in the nature of Writ of Mandamus,

declaring the action of the Respondents, particularly Respondent

No.1 in issuing the provisional select list including provisiona lly

selecting 6TH respondent and placing at SI.No.8 to the post of

Dental Technician though the Respondent No.6 is not having proper

educational qualification as per the notification issued on

24.11.2023 for the recruitment appointmen t to the post of Dental

Technician as illegal, arbitrary, unconstitutional, contrary to the

conditions in the notificationdated 24.11.2023, violative of Article 14,

16 21 of the Constitution of India and consequently set aside the

provisional selection list released in the month of November, 2023

in so far as including 6TH Respondent at SI.No.8 in pursuance to

the recruitment notification dated 24.11.2023 issued by the

Respondent No.1 and pass

IA NO: 1 OF 2025

Petition under Section 151 CPC praying that in the

circumstances stated in the affidavit filed in support of the petition,

the High Court may be pleased pleased to direct the Respondent

Nos.1 to 5 not to select Respondent No.6 for the post of Dental

Technician included in the provisional selection list at SI.No.8 in

pursuance to the recruitment notification issued on 24.11.2023 by

the Respondent No.1 and pass

ORDER :

Learned counsel for the Petitioner seeks permission of the

Court to withdraw the writ petition.

Permission as sought for is accorded.

The writ petition is dismissed as withdrawn with liberty to

pursue the legal remedies as and when occasion arises. No order as

to costs.

As a sequel, the miscellaneous petitions if any shall stand

dismissed.
