Petition under Article 226 of the Constitution of India praying that in the
circumstances stated in the affidavit filed therewith, the High Court may be
pleased to issue a Writ of Mandamus or any other appropriate Writ or Writs,
Order or Direction, declaring the action of the Respondents in changing the
web land entries and placing the petitioners property admeasuring Ac. 5.00
cents in Sy No. 1343/1 of Thenepalli Village, Puthalapattu Mandal, Chittoor
District, in Red Mark (not digitally signed)(Dispute register) as illegal,

arbitrary and without jurisdiction, violative of Art. 300-A of Constitution of
India, by setting aside the Notice in ROC No. 01/2025 dated 2.12.2025 on
the file of the 4th Respondent and to consequently direct the Respondents to
forthwith delete the above property from the category of Digitally Not Signed
and see that the same is kept in the Digitally Signed List forthwith and also
not to evict the petitioner from the above land and pass such

This Court made the following ORDER
The present writ petition is filed under Article 226 of the Constitution of
India, seeking the following relief:
“… to issue a Writ of Mandamus or any other appropriate Writ, Writs,
Order or Direction, declaring the action of the respondents in changing
the webland entries and placing the petitioner’s property admeasuring
Ac.5.00 cents in Sy.No.1343/1 of Thenepalli Village, Puthalapattu
Mandal, chittoor District, in “Red Mark” (not digitally signed) (Dispute
register) as illegal, arbitrary and without jurisdiction, violative of Article
300-A of Constitution of India, by setting aside the Notice in ROC
No.01/2025 dated 02.12.2025 on the file of the 4th respondent and to
consequently direct the respondents to forthwith delete the above
property from the category of “Digitally Not Signed” and see that the
same is kept in the “Digitally Signed List” forthwith and also not to evict
the petitioner from the above land and pass such other order …”
2. Learned Government Pleader appearing for the respondents, on
instructions has submitted that pursuant to the notice, dated 02.12.2025, the
petitioner has submitted his explanation and considering the explanation and
on perusal of the record, it shows that as on the date of grant of patta, the
petitioner was not even in service. Hence, the patta is contrary to the
provisions of the Board Standing Orders (BSO). Therefore, the respondents
are contemplating initiating appropriate action in accordance with law.

3. Considering the said submissions of the learned Government Pleader,
the Writ Petition is disposed of directing the respondents not to dispossess the
petitioner without passing appropriate orders by initiating the proceedings
under the POT Act. There shall be no order as to costs.
Miscellaneous petitions, if any, pending shall stand closed.
