Petition under Article 226 of the Constitution of India praying that in the

circumstances stated in the affidavit filed therewith, the High Court may be

pleased topleased to issue writ order or direction, more particularly in the

nature of Writ of Mandamus to declare action of the respondents 5 and 6 in

not mutating the name of the petitioner vide house no. 2/161, Ghandi Nagar

street, apolu village, gara mandal, Srikakulam District, AP is illegal arbitrary

and unconstitutional and it amounts violation of article 14,16,21 and 300A of

the constitution of the India, and direct the respondent no 5 and 6 to muted

the petitioners name vide house 2/161, Ghandi Nagar street, ampolu village,

gara mandal, Srikakulam District , AP Interms of the registered will vide

document no 35/2020 dated 3/6/2020 in the name of petitioner and to pass

ORDER

The grievance of the petitioner is that the respondent authorities are

not mutating his name for house No.2/161, Ghandi Nagar Street, Ampolu

village, Gara Mandal, Srikakulam District, despite submission of

representation.

2. The learned Standing Counsel by placing on record the written

instructions dated 30.10.2025 of the Panchayat Secretary, Ampolu Village,

submitted that the subject house bearing assessment No.909 is in the name

of mother of the petitioner, who has three sons and all the three sons are

seeking mutation in their names.

3. Since the petitioner submitted a representation for mutation, if

mutation cannot be done in his favour owing to rival claims made by his

brothers, the authorities have to pass a reasoned order on the said

representation.

4. In view of the above, this writ petition is disposed of, directing the

authorities to pass a reasoned order on the representation made by the

petitioner within a period of four (04) weeks from the date of receipt of copy

of the order. There shall be no order as to costs.

Pending miscellaneous petitions, if any, shall stand closed.
