Petition under Article 226 of the Constitution of India praying that in the

circumstances stated in the affidavit filed therewith, the High Court may be

pleased to issue a writ, order or direction more particularly one in the nature of

writ of mandamus declaring Notification dated 22-09-2023 issued by the

5th respondent herein in conducting the recruitment for the post of Angnawadi

Worker in Savara Ramalu-i'shnapuram Center, Harshabada Panchayath,

Nandigam Mandal, Tekkali Project as being illegal, arbitrary and violative of

rights guranteed under Articles 14, 16 and 21 of the Constitution of India and

further violative of the G.O.Ms.No. dated 24-08-2007 and G.O.Rt.No.102 dated

28-03-2011 and the memos dated 23-12-1998, 3-12-2010, 5-01-2012 and

13/12/2018 issued by the responIents 1and2 and further violative of the law

declared by this Honble Court in W.P.No.31374 of 2015 and batch dated

16-11-2015 and consequently setting aside the same and further declare that

the writ petitioner is entitled to be appointed as Anganwadi Worker by

promotion and pass such other orders.

IA NO: 1 OF 2023

Petition under Section 151 CPC praying that in the circumstances stated

in the affidavit filed in support of the petition, the High Court may be pleased to

grant stay of all further proceedings in pursuant to the recruitment Notification

dated 22-09-2023 issued by the 5th respondent in respect of the vacancy for

the post of Anganwadi Worker at Savara Ramakrishnapuram Center,

Harshabada Panchayath, Nandigam Mandal, Tekkali Project pending disposal

of the above writ petition and pass such other orders.

Petition under Section 151 CPC praying that in the circumstances stated

in the affidavit filed in support of the petition, the High Court may be pleased to

vacate the interim WP No. 26141 of 2023 dated 06-10-2023 and dismiss this

present writ petition and pass such other orders.

ORDER:

1. The present Writ Petition is filed to declare the Notification dated

22.09.2023 issued by Respondent No.5 for recruiting

‘Anganwadi Worker’ in Savara Ramakrishnapuram Center, Harshabada

Panchayath, Nandigam Mandal, Tekkali Project, Srikakulam District,

as illegal and arbitrary.

2. The learned counsel for the Petitioner M/s V. Mallik seeks

permission of the Court to withdraw the Writ Petition.

3. Permission is accorded.

4. Accordingly, the Writ Petition is dismissed, as withdrawn.

5. No order as to costs.

6. As a sequel, miscellaneous petitions, pending if any, shall

stand closed.
