Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to Issue a Writ of Mandamus or any other appropriate writ order or direction directing the Respondents to relieve the Petitioner from service in accordance with resignation submitted on 03.06.2025 and allow me to join my new employment before 22nd September 2025; to declare the action of Respondents in withholding resignation as illegal, arbitrary and violative of Articles 14 and 300-A of the Constitution of India and pass such other orders.

THE HONOURABLE SRI JUSTICE NYAPATHY VIJAY WRIT PETITION No.24910 of 2025
ORDER:
1. The present Writ Petition is filed questioning the action of Respondents in not relieving the Petitioner from service in accordance with the resignation submitted by him on 03.06.2025, as illegal and arbitrary.
2. The facts in brief are as follows;
The Petitioner is presently working as Manager at Punjab and Sind Bank, Zonal Office at Vijayawada. The Petitioner had joined in the Respondent-Bank on 15.07.2019 and subsequently promoted as Manager Scale-2 on 01.04.2023 and was working at Nellore Branch of Punjab and Sind Bank. On 05.06.2023, the Petitioner was posted as Manager In-Charge at Tirupati Branch. While so, on 03.01.2025, the State Bank of India had issued an advertisement for recruitment of Specialist Cadre Officers on regular basis. The post advertised is Trade Finance Officer (MMGS-II) and the last date of registration is 23.01.2025. 3. It is stated that on 06.01.2025 the Petitioner submitted an application (Application No.5011) for ‘No Objection Certificate (NOC)’ to the Respondent-Bank through the Bank’s HRMS portal and also applied for leave through HRMS portal on 18.03.2025 to attend the interview at the State Bank of India at Hyderabad. The said NOC application was approved on 29.03.2025 via HRMS portal.
4. On 03.04.2025, the State Bank of India published a list of provisionally selected candidates for the above advertisement and the name of the Petitioner was shown at Sl.No.32 confirming his selection. Subsequently, the Petitioner received an offer letter dated 10.06.2025 with an initial joining date of 16.06.2025. In the interregnum, the Petitioner had submitted resignation from the post of Manager Scale-2, Tirupati Branch Office on 03.06.2025 so as to enable him to join in
