Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus to declare the delay and inaction on the part of the Respondents No.2 in considering and disposing of the appeal filed by the petitioner as per section 5(B) of the Andhra Pradesh Rights in Land and Pattadar Pass books Act,1971 as arbitrary, illegal and consequently direct the Respondents No.2 to consider and dispose of the appeal filed by the petitioner as per section 5(B) of the Andhra Pradesh Rights in Land and Pattadar Pass books Act forthwith and may pass IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the Respondents No.2 to consider and dispose of the appeal filed by the petitioner as per section 5(B) of the Andhra Pradesh Rights in Land and Pattadar Pass books Act, 1971 forthwith, pending disposal of the Writ Petition in the interest of justice.

ORDER:

The present Writ Petition is filed, under Article 226 of the Constitution of India, seeking the following relief:

“to issue any writ, order or direction more particularly one in the nature of Writ of Mandamus or an appropriate writ or order declaring the delay and inaction on the part of the Respondents No.2 in considering and disposing of the appeal filed by the petitioner as per section 5(B) of the Andhra Pradesh Rights in Land and Pattadar Pass books Act,1971 as arbitrary, illegal and consequently direct the Respondents No.2 to consider and dispose of the appeal filed by the petitioner as per section 5(B) of the Andhra Pradesh Rights in Land and Pattadar Pass books Act forthwith and may pass….”

2. Heard Mr. Sazid Kallur, learned counsel for the petitioner and learned Assistant Government Pleader appearing for respondents.

3. In spite of service of notice, respondent nos.3 to 5 did not choose to appear either in person or by engaging any Advocate.

4. Learned Assistant Government Pleader appearing for official respondents submitted that the Court may pass appropriate orders.

5. Considering the submission and on perusal of the material available on record, without going into the merits of the case, the Writ Petition is disposed of directing the respondent no.2 to consider the appeal filed by the petitioner and pass appropriate orders after following the procedure contemplated under the Andhra Pradesh Rights in Land and Pattadar Pass books Act,1971 within a period of four (04) months from today. No costs.

As a sequel thereto, interlocutory applications pending, if any, in the Writ Petition, shall also stand closed.
