Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased toto issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus, to declare the action of the respondents in selecting the 4th respondent as Fair Price Shop Dealer of Shop No. 1319006, (Shop No.6) Kodumuru village and Mandal, Kurnool District, though the petitioner secured highest marks than the 4th respondent, as being illegal, arbitrary, unjust and unconstitutional and consequently call for the records pertaining to the selection of the Fair Price Shop Dealer of Shop No. 13190-06 (shop No.6) of Kodumuru village and Mandal, Kurnool District and to appoint the candidate as per the merit, and to grant IA NO: 1 OF 2018 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to grant stay of all further proceedings including issuance of the appointment orders to the 4th respondent as Fair price Shop Dealer of 1319006 of Kodumuru village and Mandal, Kurnool District, pending disposal of the main Writ Petition, and to pass Counsel for the Petitioner:

The Court made the following:

ORDER:-

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:

“….to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus, to declare the action of the respondents in selecting the 4th respondent as Fair Price Shop Dealer of Shop No. 1319006, (Shop No.6) Kodumuru village and Mandal, Kurnool District, though the petitioner secured highest marks than the 4th respondent, as being illegal, arbitrary, unjust and unconstitutional and consequently call for the records pertaining to the selection of the Fair Price Shop Dealer of Shop No. 13190-06 (shop No.6) of Kodumuru village and Mandal, Kurnool District and to appoint the candidate as per the merit, and to grant...”

2. By an order dated 12.07.2024, this Court directed the Registry to issue notice to the petitioner, as the learned counsel for the petitioner had passed away. However, the notice was returned un-served with the endorsement “no such person at this address.” Thereafter, by order dated 08.12.2025, the Registry was directed to print the name of the petitioner in the cause list, and the matter was listed on 10.12.2025. Despite the same, there was no representation on behalf of the petitioner, and accordingly, the matter was listed today under the caption “For Dismissal.” Even today, there is no representation for the petitioner.

3. In that view, the Writ Petition is dismissed for default. There shall be no order as to costs.

Consequently, Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
