ORDER:
This Writ Petition is filed under Article 226 of Constitution of India with the following prayer:
“…to issue a Writ of mandamus or any other appropriate writ order or direction declaring the action of the Respondents in not conducting any investigation in pursuant the petitioners complaint dt.15.09.2025 in relating to the death of petitioner No.2’s brother namely P.Nikhil Kumar against the persons who committed the murder of P.Nikhil Kumar is illegal, arbitrary and consequently direct the respondents to forthwith apprehend the persons namely G. Pavani, P. Harish Kumar and P.Venugopal who committed the murder of P.Nikhil Kumar and investigate the same by filing appropriate charge sheet.…”
2. Heard Sri N.Aswartha Narayana, learned counsel for the petitioners and Sri V.Farook, learned Assistant Government Pleader for Home.
3. Learned counsel for the petitioners would submit that respondent police are not conducting proper investigation pursuant to the complaints of the petitioners. He would further submit that they have furnished information including the evidence to the Investigating Officer in this matter. Let there be a direction to him, to consider such material and take appropriate steps in the investigation.
4. Learned Assistant Government Pleader for Home, would submit that based on the complaint given by one G.Pavani, wife of the deceased, a case has been registered in FIR No.135 of 2025 under Section 194 of BNSS (death cause not known). He would further submit that the postmortem report and RFSL report also received in this matter. Investigation is still pending.
5. Considering the submissions, this Writ Petition is disposed of. However, the Investigating Officer is directed to look into the representation of the petitioners and the information, evidence furnished by them and take appropriate steps according to law. No order as to costs.
As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed.
