6. A V S LAXMI The Court made the following ORAL ORDER:

Heard Sri T. Deva Deepak, Ld. Counsel appearing on behalf o Sri K.

Ananda Rao, Ld. Counsel for the Writ Petitioner.

2. The prayer sought in the present Writ Petition is as under:

“In the light of facts stated above, it is prayed that this Hon’ble Court may be pleased to issue writ, order or direction more in the nature of mandamus or any other appropriate writ declaring the action of the 5th Respondents in supplying the LPG (HP) Cylinders to the customers in the area of operation allotted to the petitioner and also the action of the Respondents 2 and 3 in not taking appropriate action against the 5th Respondent preventing from supplying the LPG (HP) Cylinders to the customers in the area allotted to the petitioner i.e., within 15 kms. radius of Kollipara Mandal of Guntur District as illegal, arbitrary and contrary to Articles 14 and 19 (1) (G) of Constitution of India and consequentially direct the Respondents 2, 3 & 5 to surrender the customers list within 15 Kms. radius of Kollipara Mandal of Guntur District to the petitioner, not to supply LPG (HP) Cylinders to the Customers within 15 Kms. raidus of Kollipara Mandal of Guntur District and to pass such other order or orders as this Hon’ble Court may deem fit and proper in the circumstances of the case.”

3. The above extract of the prayer itself would indicate that the dispute relates to the action of the Respondent No.5 in supplying the LPG (HP Cylinders) to the customers in the area of operation.

4. The docket would indicate that there is no interim order granted by this Court and therefore, the Respondent No.5 would have continued for more than 15 years supplying the LPG (HP Cylinders) in the area of operation. Having regard to the above facts, this Court is of the opinion that no cause of action survives in this Writ Petition.

5. Accordingly, this Writ Petition is disposed of as having become infructuous. No order as to costs. However, liberty is granted to the Writ Petitioner to restore this present Writ Petition to its’ file within eight (08) weeks from today, if the Writ Petitioner is of the opinion that the cause still survives.

6. Registry is directed to not to destroy the record for a period of twelve (12) weeks. If the Application for restoration is not filed within eight (08) weeks from today, the Registry is at liberty to destroy the record thereafter.

7. Interlocutory Applications, if any, stand closed in terms of this order.
