This Court made the following ORDER:

1. This Writ Petition is filed under Article 226 of the Constitution of India by the Petitioners for the following relief:

“to issue an appropriate Writ, Order or direction more particularly one in the nature of Writ of MANDAMUS declaring the impugned proceedings dated 11-04-2025 issued by the 3rd respondent where under converting the agricultural land into non agricultural purpose in L.P.No.3188 of total extent of 0.4360 (Ac.0.87 cents) of Vasi Village, Srungavarapu Kota Mandal, Vizianagaram District in favour of the unofficial respondents without considering the objections raised by the petitioners as well as without considering the title of the respondents 6 and 7 over the property as arbitrary, illegal and violative of provisions of Andhra Pradesh Agricultural Land (Conversion for Non-Agricultural Purposes) Act, 2006 part from violation of right to property guaranteed under Article.300-A of the Constitution of India and consequently set aside the same and pass…”

2. Heard the learned counsel for the petitioners and the learned Government Pleader for the respondents.

The learned counsel for the petitioner submits that the 3rd respondent issued the impugned proceedings dated 11.04.2025, whereby the agricultural land was converted for non-agricultural purposes in L.P.No.3188, to an extent of Ac.0.87 cents, situated at Vasi Village, Srungavarapu Kota Mandal, Vizianagaram District, in favour of the unofficial respondent, without considering the objections raised by the petitioner. Hence, the present writ petition has been filed.

After hearing the matter and upon a perusal of the provisions of the Andhra Pradesh Agricultural Land (Conversion for Non-agricultural Purposes) Rules, 2018, it is evident that Section 8 clearly provides that any aggrieved person may file a complaint before the Chief Commissioner of Land Administration (CCLA), and upon receipt of such complaint, the said authority is empowered to cause an enquiry to be conducted and to pass appropriate orders in accordance with the provisions of the Rules made thereunder.

5. In view of the same, the writ petition is disposed of, granting liberty to the petitioner to file a complaint before the competent authority, namely the Chief Commissioner of Land Administration (CCLA), within a period of three (03) weeks from the date of receipt of a copy of this order. Upon such filing, the respondent authorities shall consider the same and pass appropriate orders, in accordance with law, within a reasonable time. No costs.
