Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased topleased to pass an issue a Writ of Direction or an Order which particularly in the nature of WRIT OF MANDAMUS, declaring the inaction of the respondent no. 3 in pursuant to proceedings dated 23.07.2023 of the respondent no.2 in dis-obeying the orders to conduct detailed enquii y on the allegations against the respondent no.6 on the representation of the petitioner 09.06.2023, even the petitioner submitted a representation to Respondent No.3 on 04.09.2023 to conduct enquiry is illegal, arbitrary and unconstitutional and to pass IA NO: 1 OF 2023 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to direct the respondents No.3 to conduct impartial inquiry into the allegations against respondent no.6 to keep the respondent no.8 out of contractual employment with immediate effect and not to accommodate in any post relating to MGNREGS works in Chinthagunta GP, pending disposal of the writ petition and to pass Counsel for the Petitioner:

ORDER This writ petition is filed questioning inaction of respondent no.3 in conducting enquiry and taking action against respondent no.8.

2. Sri M.Sudheer, learned Standing Counsel, submitted that pursuant to filing of the writ petition, an enquiry was conducted and respondent no.8 had tendered his resignation and therefore, nothing survives for adjudication in this writ petition and hence the same may be dismissed as infructuous.

3. Sri P.Madhu Sudhan, learned counsel for the petitioner, submitted that an enquiry was conducted and respondent no.8 had submitted his resignation and thus cause in this writ petition had become infructuous. 4. In view of the submissions made by both the learned counsel, this writ petition is dismissed as infructuous. There shall be no order as to costs.

Pending miscellaneous petitions, if any, shall stand closed.
