Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased toto issue an appropriate Writ, order or direction, more particularly one in the nature of WRIT OF MANDAMUS declaring the appointment of the 3rd respondent as Anganwadi worker at Katarupalli (cross) centre, Kadiri east, Gandlapenta Mandal, Anantapur District by the first and second respondents is arbitrary, illegal and in violation of the Articles 14, 16 and 21 of the Constitution of India and consequently direct the first and second respondents to appoint the petitioner as Anganwadi worker at Katarupalli (cross) centre, Kadiri east, Gandlapenta Mandal, Anantapur District IA NO: 1 OF 2013(WPMP 23094 OF 2013 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to suspend the orders of the first and second respondent in appointing the 3rd respondent as Anganwadi worker at Katarupalli (cross) centre, Kadiri east, Gandlapenta Mandal, Anantapur District pending disposal of the above Writ Petition Counsel for the Petitioner:

ORDER:

1. The petitioner is challenging the appointment of respondent No.3 as an Anganwadi Worker. It is the claim of the petitioner that she is more meritorious when compared to respondent No.3 and that she is also a disabled person with 74% disability and the respondents ought to have considered the disability of the petitioner and appointed the respondent as an Anganwadi Worker.

2. The learned Assistant Government Pleader, on the contrary, submits that the petitioner and respondent No.3 appeared for the interview and that the Selection Committee had shortlisted as many as five candidates for the said post. It is also submitted that, for the post of Anganwadi Worker, no preferential marks are awarded for physical disability. Respondent No.3 secured more marks than the petitioner and, as such, was rightly issued the orders of appointment on the recommendation of the Selection Committee. The relevant proceedings relating to the selection have been placed before this Court.

3. In view of the above considerations, this Court is not inclined to interfere. Accordingly, writ petition stands dismissed. There shall be no order as to costs.

Pending miscellaneous petitions, if any, shall stand closed.
