The present Writ Petition is filed to declare the action of Respondents in withholding an amount of Rs.1,36,60,298/- even after finalizing the bills payable to the Petitioner in relation to the work, i.e., construction of the bridge across the Gostani River on the road from Kakimanuvalasa to Saravannapalem of Ananthagiri Mandal of Visakhapatnam District under SCA Grant through the Circle Agreement No.67/2022-2023/DB, dated 08.12.2022, as illegal and arbitrary.
2. In the Counter Affidavit filed by the Respondent No. 8/the Executive Engineer, Tribal Welfare, Araku, Alluri Seetharamaraju District, it is stated that the Petitioner had taken up the work as stated above and completed the same. It is also stated that the Assistant Executive Engineer, Deputy Executive Engineer, and Executive Engineer concerned have recorded the measurements in M Books and processed the bills to the extent of the works executed by the Petitioner and forwarded the same to the Project Officer, ITDA, Paderu, for arranging payment. The details of the bills were also mentioned in the tabular statement. As per the Tabular Statement, an amount of Rs.1,22,15,677/- is due to be paid to the Petitioner. It is stated that as and when the funds are released, payments will be made to the Petitioner directly into his account.
3. As there is no dispute with regard to the works and the bills of Rs.1,22,15,677/-, the present Writ Petition is disposed of with the following terms:
i) The Respondents are directed to pay an amount of Rs.1,22,15,677/- to the Petitioner within a period of three months from the date of receipt of a copy of this Order.
ii) There shall be no order as to costs.
As a sequel, the miscellaneous petitions, if any, pending in this case shall stand closed.
