Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a writ or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the inaction of the Respondents No.4 and 5 in mutating the name of the petitioner in respect of the house property bearing Door No. 1-129, admeasuring 15 feet X 20 feet, situated at Tummikapalli Village, Kothavalasa Mandal, Vizianagaram District, despite recording of full satisfaction in E.P.No.117 of 1991 in O.S.No.25 of 1977 and E.P.No.68 of 1998 in O.S.No.85 of 1984 by the learned Senior Civil Judge, Vizianagaram, as illegal, arbitrary, unreasonable and violative of Articles 14 and 300-A of the Constitution of India, and consequently direct the Respondents No.4 and 5 to mutate the name of the petitioner in the Gram Panchayat and revenue records in respect of the said property on the representation of the petitioner, dated 17-09-2025 within a time frame to be fixed by this Honble Court, and pass IA NO: 1 OF 2026 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the Respondents No.4 and 5 to consider the petitioner’s representation, dated 17-09-2025 pass orders within a fixed time frame by communicating the same to the petitioner herein and pass Counsel for the Petitioner:

Heard Sri Kondeti Ranga Srinivas, learned counsel for the petitioner, Sri P.Rajesh Kumar, learned Assistant Government Pleader for Panchayat Raj and Rural Development for the 1st respondent, Ms. Usha, learned Assistant Government Pleader for Revenue for the respondents 2 and 5, and Sri Chaitanya, learned counsel representing Sri Y.Koteswara Rao, learned Standing counsel for the respondents 3 and 4.

2. The grievance of the petitioner is that the respondents 4 and 5 are not mutating his name in respect of the house property bearing Door No.1-129, admeasuring 15 X 20 feet, situated at Tummikapalli Village, Kothavalasa Mandal, Vizianagaram District.

3. Learned counsel for the petitioner would submit that one Sri Gokeda Sanyasi @ Sannibabu filed E.P.No.117 of 1991 in O.S.No.25 of 1977 on the file of the Senior Civil Judge, Vizianagaram, seeking the sale of the house property bearing Door No.1-129. The petitioner paid the entire EP amount on behalf of JDr, and the Executing Court recorded a full satisfaction on 30.04.1998 and closed E.P.No.117 of 1991. Thereafter, the said Sri Gokeda Sanyasi filed another Execution Petition, being E.P.No.68 of 1998 in O.S.No.85 of 1984, on the file of the Senior Civil Judge, Vizianagaram, for the sale of house property bearing Door No.1-129.
