Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased toto issue a writ, order or direction in the nature of mandamus declaring the action of the 2nd and 3rd respondents in encroaching on the petitioners land of 445sq.yrds situated in S.no. 486/1 adjoining the house with D.no 13-2-100 in Pithapuram as illegal,arbitrary ,violative of the petitioners constitutional rights including art 21 and 300A etc and with a consequential direction not to disturb petitioners peaceful possession and enjoyment and pass IA NO: 1 OF 2018 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to order stay of all proceedings of the 2nd and 3rd respondents including making any constructions etc in the petitioners land of 445 sq.yrds situated in S.no.486/1in Pithapuram ,pending writ petition and pass Counsel for the Petitioner:

The Court made the following ORDER:

It is brought to the notice of this Court that the learned counsel for the petitioner is no more.

2. On the other hand, learned Assistant Government Pleader for Revenue, on instructions, submits that the 2nd respondent is not interfering with the possession and enjoyment of the property situated in Sy.No.486/1 to an extent of 445 sq.yards of Pitapuram of East Godavari District.

3. In view of the same, the cause in the writ petition does not survive for adjudication. However, it is open for the petitioner to approach appropriate forum, if the respondents take any action.

4. With this observation, the Writ Petition stands disposed of. There shall be no order as to costs.

As a sequel, miscellaneous applications pending, if any, shall stand closed.
