Petition under Article 226 of the Constitution of India praying that in the

circumstances stated in the affidavit filed therewith, the High Court may be

pleased toIssue a writ or order or direction, more particularly one in the nature

of writ of mandamus declaring the Proceedings of the 2nd Respondent vide

letter No.1409/12/EGS/CS-1 Dated 16.07.2012 which is arbitrary, bad and

illegal and contrary to law and non application of mind and violation of Article-

14 of the Constitution of India and violation of principles of natural justice and

contrary to the Service Conditions and the same liable to be set aside,

consequently direct the Respondents to continue the petitioner as Field

Order:-

1. There is no representation for the petitioner.

2. Learned Standing Counsel for the 2nd respondent submits that the

petitioner has preferred a statutory appeal before the District Collector, and

the District Collector has passed an order dated 19.01.2013.

3. Considering the said submission, the proceedings dated 16.07.2012

have already been adjudicated by the competent authority in the appeal. As

such, nothing further survives to be adjudicated on merits, insofar as the

impugned proceedings in the writ petition are concerned. Accordingly, writ

petition is closed. There shall be no order as to costs.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
