Petition under Article 226 of the Constitution of India praying that in the
circumstances stated in the affidavit filed therewith, the High Court may be
pleased to issue a writ of mandamus or any other appropriate writ or direction
declaring the action of the Respondents in withholding the payment of final
bill amount of Rs.2,55,74,174/- even after finalizing the bills, payable to the
petitioner in relation to the work i.e., Package No. APAM/YSR/Mydukur/01,
Consisting of 05 Road works in Mydukur Constituency of YSR Kadapa
District. , vide C.R. agreement No. /2022-23, dt.20.10.2022, is questioned, as
the same is illegal, arbitrary and consequently direct the respondents to
consider for payment of Rs.2,55,74,174/- with interest @12percent per
annum for the delayed amount to the petitioner in respect of execution of
above-mentioned work forthwith and pass such

Heard Sri Anand Surya, learned counsel representing Sri Suresh Kumar
Reddy Kalava, learned counsel for the petitioner, Sri P.Rajesh Kumar, learned
Assistant Government Pleader for Panchayat Raj and Rural Development &
Finance and Planning Department, for the respondents.
2. The above writ petition was filed to declare the action of the
respondents withholding the payment of the final bill amount of
Rs.2,55,74,174/- even after finalising the bills, payable to the petitioner in
relation to the work i.e., “Package No.APAM/YSR/Mydukur/01, Consisting of
05 Road works in Mydukur Constituency of YSR Kadapa District”, vide
C.R.agreement No…/2022-23, dated 20.10.2022, as illegal and arbitrary.
3. Learned counsel for the petitioner would submit that the Managing
Partner of the petitioner and the 3rd respondent entered into an agreement in
relating to the aforementioned works on 20.10.2022. Thereafter, the petitioner
carried out the works. However, the amount was not released.
