Petition under Article 226 of the Constitution of India praying that in the
circumstances stated in the affidavit filed therewith, the High Court may be
pleased to issue a writ, order or direction more particularly one in the nature of
Writ of Mandamus, declaring the action of the respondent in selecting the 7th
respondent as Anganwadi worker in respect of Veerabadrapuram Village,
Ardhaveedu Mandal, Prakasam District instead of the petitioner as arbitrary,
illegal and contrary to the 0.0.Ms.No.15 dated 4.4.2012 and consequently
direct the respondent to cancel the selection of the 7th respondent and
selecting the petitioner as Anganwadi worker in respect of Veerabadrapuram
Village, Ardhaveedu Mandal, Prakasam District in the interest of justice.

Order:-
The petitioner is challenging the appointment of the 7th respondent as
Anganwadi worker for Veerabadrapuram Village, Ardhaveedu Mandal,
Prakasam District.
2. The petitioner, after completing the 10th class, also furnished the
intermediate and thereafter completed graduation. The petitioner attended the
interview for the post of Anganwadi worker along with the other applicants.
However, the 7th respondent was preferred by the official respondents.
The primary contention of the petitioner is that the petitioner secured the
highest marks in 10th class and also has higher qualification as compared to
the 7th respondent. Though the petitioner is qualified and has secured higher
marks in 10th class as compared to the 7th respondent, the respondent
authorities have preferred the 7th respondent and appointed her.
3. The learned Assistant Government Pleader appearing for the State has
placed on record the written instructions as received. As seen from the
instructions, it is evident that the District Selection Committee has considered
the applications received and awarded the marks as per the notification to the
candidates which they deserved. Insofar as the petitioner is concerned, the
Selection Committee awarded 57 marks and the 7th respondent was awarded
63 marks. It is also stated in the counter that all candidates who passed SSC
were awarded 50 marks and securing higher marks in SSC examination would
not entitle the applicants for the marks beyond 50.
