Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased toto issue a writ, or order or direction more particularly one in the nature of Writ of Mandamus declaring the inaction of the respondents 1 & 2 in granting Approval/Letter of Permission for the increase of intake from 100 to 150 for MBBS course to the petitioner college from the academic year 2014- 15 inspite of compliance of objections by the petitioner and submitted to the 1st respondent during the hearing on 27-6-2014, as illegal, arbitrary and violative of Articles 14 and 19(1)(g) of the Constitution of India and consequently direct the respondents No.1 and 2 to grant approval to the petitioner college for increase of intake from 100 to 150 seats for MBBS Course from the academic year 2014-15 onwards IA NO: 1 OF 2014(WPMP 24569 OF 2014 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the respondents No.1 and 2 to forthwith consider for grant of permission for increase of intake from 100 to 150 seats to the petitioner college for MBBS Course from the academic year 2014-15 onwards, pending disposal of the writ petition Counsel for the Petitioner:

ORDER:

Heard learned counsel for the petitioner.

2. The claim of the petitioner is that seeking permission for increase of intake from 100 to 150 for MBBS course to the petitioner college from the academic year 2014-2015.

3. In the present Writ Petition, the increase of intake to be granted in favour of the petitioner’s medical college is from a particular year. Therefore no cause survives.

4. Accordingly, the Writ Petition is dismissed as infructuous. There shall be no order as to costs.

As a sequel, miscellaneous petitions, if any, pending shall stand closed.
