The Court made the following:

ORDER:

The Criminal Petition has been filed under Section 482 of the Bharatiya

Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) by the

Petitioner/Accused for granting of pre-arrest bail in connection with Crime

No.101 of 2025 of Prohibition and Excise Station, Kothapeta Dr Ambedkar

Konaseema District, registered for the alleged offence punishable under

Section 7-B read with 8-A and B of the Andhra Pradesh Prohibition Act, 1995

(for brevity ‘the APP Act’).

2. Heard the learned Counsel for the Petitioner and the learned Assistant

Public Prosecutor.

3. As seen from the record, the Prohibition and Excise officials of

Kothapeta drafted a special report alleging that the petitioner was

manufacturing 40 litres of I.D. liquor and 1,300 litres of F.J. wash. The

petitioner was neither found at the spot nor arrested at the time of the alleged

incident. The Excise officials, upon making inquiries with the neighbours,

came to know that the petitioner was allegedly indulging in the said activity.

However, no similar criminal adverse antecedents are reported against the

petitioner.

4. The learned counsel for the petitioner submits that, for statistical

purposes and due to political influence, a false case has been foisted against

the petitioner. The petitioner is a coolie and a permanent resident of

Peravaram Village, Atreyapuram Mandal, Dr.B.R. Ambedkar Konaseema

District.

5. Considering the facts and circumstances of the case, gravity and nature

of the allegations levelled against the Petitioner/Accused, this Court is inclined

to grant pre-arrest bail to the Petitioner/Accused.

6. In the result, the Criminal Petition is allowed with the following

conditions:

i. In the event of arrest of the Petitioner/Accused, he shall be

enlarged on bail subject to his executing a self-bond for a

sum of Rs.10,000/- (Rupees Ten Thousand only), with two

sureties for the like sum each to the satisfaction of the

arresting police officials.

ii. The Petitioner/Accused shall make himself available for

investigation as and when required.

iii. The Petitioner/Accused shall not cause any threat,

inducement or promise to the prosecution witnesses.

iv. The Petitioner/Accused shall appear before the Station

House Officer concerned once in a week i.e., on every

Saturday between 10.00 a.m. and 5.00 p.m., till filing of the

charge sheet.

The Petitioner/Accused shall not leave the State of Andhra

v.

Pradesh limits without the express permission from the

Station House Officer concerned.

vi. The Petitioner/Accused shall surrender his passports, if any,

to the investigating officer. If he claims that he does not have

passport, he shall submit an affidavit to that effect to the

Investigating Officer.
