Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased toto issue an appropriate writ, order or direction more particularly one in the nature of 'Writ of Mandamus' declaring the Proceedings in Rc.No.367/DVC/Social Audit/2012, Dt.24-08-2013 of the 4th Respondent and consequential proceedings in Rc.No.258/DVC/2013, Dt.13-02-2014 of the 3rd Respondent as illegal arbitrary and violative of Articles 14, 16 and 21 of the Constitution of India apart from the violation of principles of natural justice IA NO: 1 OF 2014(WPMP 18389 OF 2014 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the respondents to re-instate the Petitioner into service by suspending the impugned Proceedings in Rc.No.367/DVC/Social Audit/2012, Dt.24-08-2013 of the 4th Respondent and consequential proceedings in Rc.No.258/DVC/2013, Dt.13-02-2014 of the 3rd Respondent

WRIT PETITION No.14848 OF 2014

ORDER:

1. The petitioner is challenging the order passed by the 4th respondent and seeks a direction to continue him as Field Assistant.

2. The learned Standing Counsel appearing for the respondent No.4 submits that the petitioner was engaged as Field Assistant on a contract basis for a specified period of time and that the period of contract also expired. It is also submitted that the order under challenge is appealable, and that the petitioner has an effective alternative remedy by way of an appeal before the District Collector. Hence, this Court is not inclined to entertain the present writ petition.

3. Accordingly, the writ petition is dismissed. There shall be no order as to costs.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
