THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA CRIMINAL PETITION NO: 14566/2014 ORDER:

This Criminal Petition is filed under Section 483(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023 (corresponding to Section 439(2) Cr.P.C.), seeking cancellation of the anticipatory bail granted to respondent No.2/accused vide order dated 10.10.2014 in Crl.P.No.12360 of 2014 in Crime No.175 of 2014 of Indukurpet Police Station.

2. There is no representation on behalf of the petitioner. Heard the learned Assistant Public Prosecutor appearing for the State.

3. The case of the petitioner, as set out in the petition, is that respondent No.2 developed acquaintance with her, promised to marry her, and on that pretext had physical relations with her, resulting in pregnancy and subsequent abortion. It is alleged that respondent No.2 later refused to marry her and threatened her with dire consequences. On the basis of her complaint, Crime No.175 of 2014 was registered by Indukurpet Police Station for the offences punishable under Sections 417, 420 and 506 IPC.

4. It is further stated that the anticipatory bail applications filed by respondent No.2 before the learned District and Sessions Judge, Nellore, were dismissed. However, this Court, by order dated 10.10.2014 in Crl.P.No.12360 of 2014, granted anticipatory bail to respondent No.2. The petitioner alleges that thereafter respondent No.2 and his family members harassed and threatened her to compromise the case and that he, being a police official, is likely to influence the investigation and tamper with evidence.

On the said grounds, cancellation of anticipatory bail is sought.

5. Learned Assistant Public Prosecutor submits that no specific circumstances or violations of bail conditions have been brought to the notice of this Court warranting cancellation of bail.

6. In the present case, the offences alleged are punishable under Sections 417, 420 and 506 IPC. The crime pertains to the year 2014. Except making general allegations, no material is placed before this Court to establish that respondent No.2 violated any of the conditions imposed while granting anticipatory bail.

7. In the absence of any specific grounds warranting exercise of power under Section 439(2) Cr.P.C. (now Section 483(3) BNSS), this Court is not inclined to cancel the bail granted to respondent No.2.

8. Accordingly, the Criminal Petition is dismissed.

As a sequel, miscellaneous petitions, if any, pending shall stand closed.
