Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of Respondent Nos. 4 and 5 at instance of Respondent No. 6, in contemplating to form a Gravel Road through the Petitioners' agricultural landed property admeasuring an extent of Ac.5.24 cents covered by Sy. Nos. 180-1 B-A, 181-1A, 181-1 B, 177, 178, 179, 180-1A-B, 165- 6, 180-4, 180-2 and 180-3 situated in Kolathuru Revenue Village of Varadaiahpalem Mandal in Tirupati District, without initiating any acquisition proceedings, as illegal, irregular, irrational, and violative of provisions of Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 and its governing Rules and offends Articles 14,21 and 300-A of the Constitution of India and consequently direct the Respondents specifically Respondent Nos. 4 and 5 not to interfere with the Petitioners' peaceful possession and enjoyment over his said land nor form any Road thereon IA NO: 1 OF 2026 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the Respondents specifically Respondent Nos. 4 & 5 not to form any Road over Petitioners' exclusive private landed property admeasuring Ac.5.24 cents covered by Sy.No.180-1B-A, 181-1A, 181-1 B, 177, 178, 179, 180-1A-B, 165-6, 180-4, 180- 2 and 180-3 situated in Kolathuru Revenue Village of Varadaiahpalem Mandal in Tirupati District, pending disposal of the main Writ Petition Counsel for the Petitioner:

The above writ petition is filed to declare the action of respondents 4 and 5 in contemplating to form a gravel road through the petitioner’s agricultural land admeasuring Ac.5-24 cents, covered by survey Nos.180-1B- A, 181-1A, 181-1B, 177, 178, 179, 180-1A-B, 165-6, 180-4, 180-2 and 180-3 situated in Kolathuru Revenue Village of Varadaiahpalem Mandal, Tirupati District, without following due process of law, as illegal and arbitrary.
