Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in not considering the petitioner for the post of Anganwadi Worker in ICDS Project, Penugonda, Chinnaboinapalli (V), Kotthacheruvu (M), Anantapur Dist., as bad, arbitrary and contrary to G.O.Ms. No. 15, dt. 04.04.2012 and also offends Arts. 14, 16 & 21 of the Constitution of India apart from violation of principles of natural justice and to pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case.
IA NO: 1 OF 2013(WPMP 19974 OF 2013 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the respondents to consider the petitioner for the post of Anganwadi Worker in ICDS Project, Penugonda, Chinnaboinapalli (V), Kotthacheruvu (M), Anantapur Dist., as per G.O.Ms. No. 15, dt. 04.04.2012 pending disposal of the main writ petition and to pass such other order or orders in the interest of justice and fair play.

Order:-
The petitioner is challenging the inaction on the part of the respondents in selecting the petitioner as Anganwadi Worker.
2. It is stated in the affidavit that the petitioner is qualified for appointment and has also submitted the application in pursuance of the notification. The petitioner also attended the interview along with other candidates. The petitioner further states that the respondents have preferred a candidate who has secured lesser marks than the petitioner in the S.S.C. examination. On these considerations, the petitioner states that she is entitled for selection instead of the candidate who was shortlisted, though the said candidate secured lesser marks than the petitioner.
3. The learned Assistant Government Pleader appearing for the State submits that the Selection Committee has selected the candidate who fared better in the interview and the Selection Committee has identified a suitable candidate by name C. Siva Latha as a suitable candidate for appointment.
4. It is also stated in the counter that the educational qualification for appointment as Anganwadi Worker is S.S.C. and securing higher marks in S.S.C. would not entitle the applicants for any higher marks. The Selection Committee has appropriately awarded the marks to the candidates who have appeared and has identified the suitable candidate. It is also stated that the selection process is transparent and the selected candidate is working.
5. On these considerations, this Court is not inclined to interfere.
6. Accordingly, this writ petition is dismissed. There shall be no order as to costs.
As a sequel, miscellaneous petitions pending, if any, shall stand closed.
