Regularization of service and grant of probation are contingent upon the fulfillment of mandatory qualifications within the prescribed timeframe; failure to do so precludes entitlement to benefits from the initial date of appointment.

Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the respondents to regularize the service of the petitioner in the cadre of Typist and release all the increments and other benefits, pending disposal of the Writ Appeal and to pass

JUDGMENT:

1. This Writ Appeal is filed against the order, dated 14.10.2025 in W.P.No.27711 of 2025.

2. The appellant is the writ petitioner. He filed the writ petition questioning the action of the respondents therein in not regularizing his services in the cadre of Typist and thereby not releasing the periodical increments and other benefits.

Originally, the petitioner was appointed as Typist on compassionate grounds by the District Collector, Visakhapatnam, vide proceedings RC.No.765/2013/A2, dated 05.06.2013, on condition that the petitioner has to acquire Typewriting Higher Grade in Telugu within two (02) years from the date of appointment order.

4. As per the petitioner, he had acquired Typewriting Higher Grade in Telugu in the month September, 2023. Now, he is claiming for regularization of his services for grant of annual increments and for probation from initial date of appointment.

Having considered the submissions advanced by learned counsel for the petitioner and learned Assistant Government Pleader and on perusal of the relevant Government Orders, a learned Single Judge of this Court is pleased to dispose of the said writ petition, directing the respondents therein to consider the case of the petitioner for declaration of probation and regularization from the month of September, 2023, i.e., when the petitioner had passed Typewriting Telugu Higher Grade within a period of three (03) months from the date of receipt of the copy of the order. Aggrieved by the same, the present writ appeal is filed.

Having heard the submissions of the respective counsels and on careful perusal of the material available on record, it is an admitted fact that the petitioner was appointed as Typist in the year 2013, on condition that he has to acquire Typewriting Higher Grade in Telugu within two (02) years from the date of appointment. It is also an admitted fact that he acquired Typewriting Higher Grade in Telugu qualification in the month of September, 2023. As such, in the absence of requisite qualification, he is not entitled for regularization from the date of his initial appointment. Though the respondents contended before the learned Single Judge that the petitioner is liable to be reverted to the lower post as he had not qualified within the time prescribed or even within the extended grace period, the learned Single Judge graciously declared as disproportionate. Even thereafter, this writ appeal is filed by the writ petitioner against the learned Single Judge order.

7. We do not find any merits in this appeal either on facts or in law to interfere with the reasoned order passed by the learned Single Judge. As such, this appeal is liable to be dismissed.

8. Accordingly, this Writ Appeal is dismissed.

9. There shall be no order as to costs.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
