particularly one in the nature of Writ of Mandamus declaring the action of the respondent no. 3 in issuing Non-dated Notice for conducting enquiry with regard to mutation of entires despite the rejection order passed by the respondent no. 4 in Sy.no. 22/2 with an extent of Ac.0.54 cents situated at Mittapalle Bit-1 revenue village, Kuppam Mandal, Chittoor District as illegal, arbitrary, unconstitutional and being violative of Articles 14, 21 and 300-A of the constitution of India and in contravention of Andhra Pradesh Rights in Land and Pattadar Pass Books Act, 1971 and consequenlty a) to direct the respondent no. 3 not to conduct the enquiry and mutation in respect of land in Sy.no. 22/2 with an extent of Ac.0.54 cents situated at Mittapalle Bit-1 revenue village, Kuppam Mandal, Chittoor District and b) to set-aside the Non- dated Notice issued by the respondent no. 4 which is in contravention of

The Court made the following Order:
Heard the learned counsel for the petitioner and the learned Assistant
Government Pleader for the respondent Nos. 1 to 5.
2. The issuance of notice to the 6th respondent is dispensed with, as no
prejudice would cause to her even if it is disposed of in her absence.
3. This writ petition is filed questioning the notice issued by the 3rd respondent to conduct enquiry, since the 4th respondent rejected the mutation
claim of the 6th respondent herein.
4. The learned counsel for the petitioner submits that the 6th respondent approached the 4th respondent for mutation of the land in LPM 1196 to an extent of Ac.0.54 cents, of Mittapalle Bit-1 Revenue Village, Gudupalle Mandal. When the 4th respondent rejected his claim, the remedy available for him is to prefer an appeal. The 4th respondent transmitted all the documents to the 3rd respondent for further enquiry and, as such, the above said
impugned notice was issued by the 3rd respondent.
