IN THE HIGH COURT OF ANDHRA PRADESH AT AMARAVATI
Subba Reddy Satti, J
K SUBBA RAO – Appellant
Versus
STATE OF ANDHRA PRADESH – Respondent
W.P.(APAT).No.950 of 2021 | O.A.No.2162 of 2017

Advocates:
For the Appellants/Petitioners: M Srikanth
For the Respondents: GP for Services IV

A writ petition is dismissed as infructuous when the petitioner's counsel concedes that the cause of action no longer survives due to the efflux of time.

Headnote:The petitioner challenged the proceedings issued in efile.No.47711/2017-A5 dated 07.07.2017, which removed them from service as a borewell operator. The petitioner sought a declaration that the removal was illegal, unjust, and violative of the principles of natural justice, requesting reinstatement with all consequential benefits. The primary issue was whether the cause of action in the writ petition survived. The court observed the submission made by the petitioner's counsel that due to the efflux of time, the cause in the writ petition did not survive and had become infructuous. this writ petition is dismissed as infructuous.

(Special Original Jurisdiction)

To declare the proceedings issued in efile.No.47711/2017-A5 Dt 7-7-2017 removing the applicant from service as illegal, unjust, contrary to rules apart from it being violative of principles of natural justice and set aside the same and consequently, direct the respondents to reinstate the applicant as borewell operator with all the consequential benefits

The Court made the following order:

The petitioner originally filed O.A.No.2162 of 2017 on the file of learned Andhra Pradesh Administrative Tribunal, at Hyderabad (for short ‘the Tribunal’) to declare the proceedings issued vide efile.No.47711/2017-A5 dated 07.07.2017, removing the petitioner from service, as illegal and arbitrary.

After the abolition of the Tribunal, the O.A. was transferred to High Court and the same is numbered as W.P.(APAT).No.950 of 2021.

Today when the matter is taken up, learned counsel for the petitioner submitted that due to efflux of time, the cause in this writ petition does not survive and the writ petition has become infructuous.

Recording the above submission, this writ petition is dismissed as infructuous. No costs.

As a sequel, pending miscellaneous petitions, if any, shall stand closed.
