Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased toto issue an appropriate Writ, order or directions mostly one which is in the nature of a Writ of mandamus, declaring the inaction of the Respondents in absorption of the petitioners into aided posts in the available vacant posts in the 5th Respondent college by granting necessary approval as illegal, irregular, arbitrary, unreasonable, unfair, unjustified and unconstitutional and direct the Respndent Nos.1 to 3 to forthwith permit the Respondent Nos. 4 and 5 to absorb the petitioners services into aided posts with effect from the date of appointment with all consequential benefits

Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the Respondent Nos.1 to 3 to permit the Respondent Nos.4 and 5 to fill up the existing aided posts in the institution by absorption of the petitioners
ORDER:
1. The petitioners are seeking a direction from this Court to absorb them into aided posts with effect from the dates of their respective appointments, and to declare that they are entitled to all consequential service benefits.
2. The learned Assistant Government Pleader, appearing for respondent Nos.1 to 3, submits that the 4th respondent has surrendered the grant-in-aid along with the aided posts. It is further submitted that, as on date, respondent No.5 is no longer an aided college, and therefore the question of considering the case of the petitioners for absorption into aided posts does not arise.
3. Recording the said submission, this Court is of the opinion that no further orders are required in the present writ petition. Accordingly, the present writ petition stands closed. There shall be no order as to costs.
Pending miscellaneous petitions, if any, shall stand closed.
