Heard Sri P. Anand Surya, learned Counsel appearing on behalf of Sri Suresh Kumar Reddy Kalava, learned Counsel for the Writ Petitioner, Sri S. Vijaya Kumar, learned Counsel appearing on behalf of Sri A.S.C. Bose, learned Standing Counsel for Municipal Corporations and Ms. D. Nagachandrika, learned Assistant Government Pleader for Finance and Planning.

2. The present Writ Petition is filed seeking following relief:

“……to issue a writ of mandamus declaring the action of the Respondents herein, in withholding the payment of CC 2nd and Part Bill in Net amount of Rs. 12,79,000/- even after finalizing the bills payable to the petitioner in relation to the work i.e., “Mangalagiri Municipality - Construction of Municipal Community Hall at Rajeev Gruhakalpa in 27th ward under General Funds vide Agreement No.96/2020-21, Dt.21.07.2020 is questioned, as the same is illegal and arbitrary apart from violates of Articles 14, 16, 19 & 300- A of the Constitution of India and consequently direct the respondents to consider for payment of bills in CC 2nd and Part Bill in Net amount of Rs. 12,79,000/- with an interest @24% per annum for the delayed amount to the petitioner in respect of execution of above-mentioned work., forthwith and pass….”

3. Sri S. Vijaya Kumar, learned Counsel appearing on behalf of Sri A.S.C. Bose, learned Standing Counsel for Municipal Corporations has submitted the Written Instruction furnished by the Commissioner, Mangalagiri Tadepalli Municipal Corporation, dated 26.01.2026. Copy of the Written Instruction is also furnished to the learned Counsel for the Writ Petitioner.

This Written Instruction is taken on record.

4. The Written Instruction would indicate that there is vigilance enquiry that is going on in respect of all contractual works relating to all works done between 2019-2014. The fact that the vigilance enquiry is pending is reflected from the Written Instruction furnished by the Commissioner, Mangalagiri Tadepalli Municipal Corporation.

5. Sri S. Vijaya Kumar, learned Counsel appearing on behalf of Sri A.S.C. Bose, learned Standing Counsel for Municipal Corporations has brought it to the notice to this Court that in the similar circumstances, the learned Single Judge of this Court vide Order dated 04.07.2025 in W.P.No.12525 of 2024 was pleased to issue certain directions by granting some time for payment of the amounts due.
