Petition under Article 226 of the Constitution of India praying that in the

circumstances stated in the affidavit filed therewith, the High Court may be

pleased topleased to issue a Writ or Order or Direction more particularly one

in the nature of Writ of Mandamus declaring the action of the 4th and the 5th

respondents in allowing the 6th respondent to erect the statue within the

premises of Thallacheruvu Milk Coperative Society as well as abetting to the

R andB road at Thallacheruvu Village, Achampet Mandal, Guntur District

without there being any permission from the respondent authorities as per

G.O.Ms. No. 55 dated 08.04.2003 as illegal, arbitrary and also oppose to all

cannons of justice more particularly oppose to G.O.Ms. No. 55 dated

08.04.2003, consequentially direct the respondent no. 2 to 5 herein not to

allow the 6th respondent in erecting the statue within the premises of

Thallacheruvu Milk Coperative Society as well as abetting to the R and B road

at Thallacheruvu Village, Achampet Mandal, Guntur District without there

being any permission as per G.O.Ms. No. 55 dated 08.04.2003 forthwith

Petition under Section 151 CPC praying that in the circumstances stated

in the affidavit filed in support of the petition, the High Court may be pleased

pleased to direct the respondent no. 2 to 5 herein not to allow the 6th

respondent in erecting the statue within the premises of Thallacheruvu Milk

Coperative Society as well as abetting to the R and B road at Thallacheruvu

Village, Achampet Mandal, Guntur District without there being any permission

as per G.O.Ms. No. 55 dated 08.04.2003 forthwith pending disposal of the

above writ petition

The Court made the following ORDER:

The Writ Petition is filed seeking relief against the 6^th respondent for

erecting a statue within the premises of Thallacheruvu Milk Coperative

Society.

2. On 02.03.2026, the learned Assistant Government Pleader based on

the written instructions, submits that, as per the survey and verification

conducted by Atchempet Mandal Surveyor and Village Revenue Officer of

Tallacheruvu Village, it has been confirmed that the land on which the

construction is being carried out, belongs to the Milk Producers Cooperative

Society. Furthermore, no statue has been erected and the land in question is

a private land, there is no encroachment of road or any Government land.

Additionally, G.O.Ms.No.55, dated 08.04.2003 is not applicable to the subject

land.

3. In view of the same, no further orders are necessary. This Writ Petition

is closed. No order as to costs.

As a sequel, miscellaneous applications pending, if any, shall stand

closed.
