Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased toto issue any writ, order, direction, probably in writ of nature of Mandamus, declaring the action of the respondents, conducting auction including our zeroyit land, land in S.no 324/10, an extent of Ac 1.00 cents and in S.no 319/2 Ac 0.61 cents and in S.no 326/2 Ac 0.50 cents and 2nd petitioner's land in s.no 324/3 an extent Ac 0.59 cen. 320/7 Ac 0.25 cents shown as mortgaged land in extent of Ac.20.42 cents in s.no 324 / 4 and 5, in Jalumuru revenue limits of Srikakulam dist, without identify the mortgaged land by I conducting proper survey by revenue authorities, and without notice or due process of law before conducting auction as illegal, irregular, unjust, arbitrary and Violation of Principle of Natural justice, offends Article 14 , 21,and 300A of Constitution of India. Consequently direct the respondents not to include the petitioners land in auction without proper verifying by revenue authorities and pass IA NO: 1 OF 2019 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the respondents not to conduct any auction in survey no 324 /4,5 of an extent of Ac 20.42 cents, without identify the mortgage lands, conducting proper survey by revenue authorities and prior notice, or without due process of law, in Jalumuru revenue limits of Jalumuru mandal of Srikakulam district, and pass Counsel for the Petitioner(S):
