Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased topleased to issue an order, direction, writ, more particularly Writ of Mandamus declaring the action of the 4th Respondent allotting the shops on nomination basis to the third parties without following the procedure near by the shops of the petitioners in Sri Venkateswara Ramnarayana Ruya Government General Hospital (SVRRGG), Tirupati, Tirupati District as illegal, arbitrary, violative of principles of natural justice and consequently direct the Respondents not to allot the shops nearby the petitioners shops i.e. Shop No.9 near Causality, Shop No.4 near Police Outpost in the premises of Sri Venkateswara Ramnarayana Ruya Government General Hospital (SVRRGG), Tirupati, Tirupati District and pass IA NO: 1 OF 2026 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to direct the Respondents not to allot the shops to nearby the petitioners shops i.e. Shop No.9 near Causality, Shop No.4 near Police Outpost in the premises of Sri Venkateswara Ramnarayana Ruya Government General Hospital (SVRRGG), Tirupati, Tirupati District, forthwith, pending disposal of the above Writ Petition and pass Counsel for the Petitioner(S):

ORDER:

This writ petition is filed under Article 226 of the Constitution of the India seeking the following reliefs:-

“to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the 4th Respondent allotting the shops on nomination basis to the third parties without following the procedure nearer to by the shops of the petitioners in Sri Venkateswara Ramnarayana Ruya Government General Hospital (SVRRGG), Tirupati, Tirupati District as illegal, arbitrary, violative of principles of natural justice and consequently direct the respondents not to allot the shops nearby the petitioners shops i.e. Shop No.9 near Causality, Shop No.4 near Police Outpost in the premises of Sri Venkateswara Ramnarayana Ruya Government General Hospital (SVRRGG), Tirupati, Tirupati District and pass such other order.”

2. Heard learned counsel for the petitioners and learned Government Pleader for the respondents.

3. Learned counsel for the petitioners submits that the 4th respondent herein is making attempts to allot a shop situated within the premises of the 4th respondent‘s hospital in favour of third parties without intervention of public auction, which is contrary to settled procedure of law.

4. Learned counsel for the petitioner further submits that it is settled law as per the Rules issued by respondent No.1, any public largesse should be allotted by way of public auction but not in other mode. She further
