The present writ petition has been filed challenging the order passed by the National Consumer Disputes Redressal Commission, dated 19.09.2024, in First Appeal No.761 of 2022 preferred by the New India Assurance Co. Ltd.

The stand of the appellants is that while the State Commission had allowed the complaint and granted compensation to the extent of Rs.27,90,000/- along with interest at the rate of 9% p.a. calculated from the date of filing of the complaint till realization, the National Commission, while W.P. No:19158 of 2025 accepting the compensation amount of Rs.27,90,000/-, had ordered interest at the rate of 6% till realization, only if the said amount was not paid within eight weeks from the date of receipt of the order.

3. It is urged by learned counsel for the petitioners that the National Consumer Commission did not give any reasons at all as to why the interest, as awarded by the State Consumer Commission, from the date of filing of the complaint till the realization of the awarded amount was not accepted.

4. We find that no reasons have been given at all by the National Consumer Commission as to why the rate of interest was slashed from 9%, which was awarded by the State Consumer Commission, to 6%. Further, we find no reasons as to why the National Consumer Commission ordered the interest to be paid only if the amount was not paid within eight weeks from the receipt of the order and not from the date of filing of the complaint, as was ordered by the State Consumer Commission. On the other hand, the State Consumer Commission had, in its order, referred to RBI guidelines to justify the grant of interest at the rate of 9% as against 12% claimed by the petitioner.

5. We, therefore, find it a fit case for remanding the matter to the National Consumer Commission, which shall go into the issue and pass orders afresh W.P. No:19158 of 2025 only on the issue of payment of interest. The Writ Petition is accordingly disposed of. No costs.

Pending miscellaneous applications, if any, shall stand closed.
