ORDER:

Today, when the matter has been taken up for hearing, learned counsel

for the petitioner has submitted that, proof of service Memo has been field before the Registry on 24.03.2026 vide U.S.R.No.36460 of 2026, along with the Postal Track Consignment Sheet downloaded from the Postal Department Website and the same has been placed on record. As per the Postal Track Consignment Sheet, the registered notice sent to the respondent and the same was served on 14.03.2026. Despite service of notice, there is no

representation on behalf of respondent. Therefore, ‘service held sufficient’.

2. The petitioner/wife herein filed the present petition under Section 24 of the Code of Civil Procedure, 1908 (for short, ‘the C.P.C.’), seeking to transfer the H.M.O.P.No.104 of 2024, on the file of learned Civil Judge (Senior Division) Yalamanchilli, to the file of learned Civil Judge (Senior Division)

Tadepalligudem, West Godavari District for trial and disposal.

3. The case of the petitioner in brief is as follows:

i. The petitioner is the legally wedded wife of the respondent/husband, and their marriage was solemnized on 15.05.2010 at Tadepalligudem, as per Hindu Marriage customs and rituals. Thereafter, due to matrimonial disputes between the parties, the petitioner/wife has been residing separately in her parents’ house

at Tadepalligudem along with her female child aged about 10 years.

2026:APHC:34716 ii. The petitioner submitted that she had lodged a complaint, which was registered as F.I.R. No. 322 of 2024 and subsequently numbered as C.C. No. 68 of 2025. She further stated that she has also filed a maintenance case, vide M.C. No. 12 of 2025. Both the matters were filed before the learned I Additional Civil Judge-cum- Judicial Magistrate of First Class, Tadepalligudem and they are

pending for adjudication.

iii. The petitioner further pleaded that the respondent/husband, to cause inconvenience to the petitioner, filed H.M.O.P.No.104 of 2024, on the file of Civil Judge (Senior Division) Yelamanchilli, seeking restitution of conjugal rights under Section 9 of Hindu Marriage Act, 1955 and the same is pending for adjudication. The petitioner further pleaded that
