Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased toFor the reasons stated in the accompanying affidavit, it is hereby prayed that this Honble Court may be to issue a Writ, order or direction more particularly one in the nature of Writ of Mandamus by declaring the action of the respondents herein more particularly the 2ND respondent in not reviewing the suspension order vide e.Proc.No.2948258/CPR/N 1/2025- 3, dated 8-9-2025, on completion of ever 4 months period of suspension as per the G.O.Ms.No.22, GAD (SER-C) Dept, dated 29-2-2024 as illegal violation of the G.O.Ms.No.22, dated 29-2-2024 andarbitrary and consequentially the Honble Court may be pleased to direct the 2nd respondent herein to review suspension order dated 8-9-2025 as per G.O.Ms.No.22, dated 22-9-2024 and consider for reinstatement into service of the petitioner as Panchayat Secretary Gr-I may pass

The Court made the following:

ORDER:

1. The present Writ Petition is filed questioning the action of Respondents in not reviewing the suspension orders dated 08.09.2025 in terms of G.O.Ms.No.22 dated 29.02.2024 as illegal and arbitrary.

2. The case of the petitioner is that the services of the petitioner was placed under suspension vide proceedings dated 08.09.2025 on the ground of misappropriation in respect of the allegations for the period from 19.10.2021 to 22.02.2022 when the petitioner worked as Panchayat Secretary, Grade-I on in-charge basis at Kaikaluru Gram Panchayat of Krishna District. In the present case, though more than eight years have been elapsed, the respondents are not reviewing the suspension of the petitioner. Infact, in terms of G.O.Ms.No.22 dated 22.09.2024, the Government has issued instructions to all the concerned authorities with a direction to review the suspension orders at the end of every four months, but in the instant case, the respondents have not reviewed the suspension order of the petitioner nor initiated any disciplinary proceedings against the petitioner.

Considering the above said submissions and on perusal of the material on record, without going into merits of the case, the writ petition is disposed of directing the respondents to consider the case of the petitioner in terms of the G.O.Ms.No.22 dated 29.02.2024 and undertake to review the suspension of the petitioner based on records within a period of one month from the date of receipt of copy of this order. No order as to costs.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
