Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue an appropriate Writ, Order or Direction more particularly one in the nature of Writ of Mandamus, declaring- i) The action of the respondents in not processing the application made by the petitioner for grant of quarry lease vide the application dt. 16.07.2018 within the time frame stipulated under G.O.Ms.No. 163, dt. 16.11.2017 as illegal, arbitrary and unconstitutional, and ii) consequently direct the respondents to process Petitioner application dt. 16.07.2018 and grant quarry leases in accordance
with the Rules and to pass IA NO: 1 OF 2022
Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the respondents to complete the processing of the applications of the petitioner dt. 16.07.2018 without considering them to have been rendered ineligible on account of the amended Rule 12(2) of the A.P. Minor Mineral
Concession Rules, 1966, and to pass Counsel for the Petitioner:

ORDER:-
The instant writ petition has been filed by the petitioner under Article
226 of Constitution of India seeking the following main prayer:
“….to issue an appropriate Writ, Order or Direction more particularly one in the nature of Writ of Mandamus, declaring- i) The action of the respondents in not processing the application made by the petitioner for grant of quarry lease vide the application dt. 16.07.2018 within the time frame stipulated under G.O.Ms.No. 163, dt. 16.11.2017 as illegal, arbitrary and unconstitutional, and ii) consequently direct the respondents to process Petitioner application dated 16.07.2018 and grant quarry leases in accordance with the
Rules and to pass….”
2. Smt. G.N. Uma Rani, learned counsel for the petitioner, submits that, in view of the subsequent events, more particularly G.O.Ms.No.100 Industries & Commerce (Mines-II) Department, dated 26.06.2025, she seeks permission to withdraw the instant writ petition with a liberty to work out the legal remedies
available to the petitioner.
3. Accordingly, in view of the submission made by the learned counsel for the petitioner, the Writ Petition is dismissed as withdrawn leaving it open to the petitioner to work out his legal remedies in accordance with law. There
shall be no order as to costs.
As a sequel, all pending applications shall stand closed.
