Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue an appropriate writ, order or direction more particularly one in the nature of Writ of Mandamus, declaring the action of the 3rd respondent in not concluding enquiry within the stipulated time in Rc.DT(LR).426/2020, dated 31.10.2025, whereby suspension of petitioner authorization for Shop No. 1382123 of Kurnool Urban, Kurnool, Kurnool District is still continuing inspite of the orders passed by this Hon'ble Court in W.P No. 30942/2025, dated 06.01.2026, as illegal, arbitrary and in flagrant disregard to law and consequently revoke the aforesaid impugned suspension order of the 3rd respondent and pass IA NO: 1 OF 2026 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased Counsel for the Petitioner:

Questioning the action of the 3rd respondent in not concluding the enquiry within the stipulated time as in the suspension order vide Rc.DT(LR).426/2020 dated 31.10.2025 inspite of the orders passed by this Court in W.P.No.30942 of 2025 dated 06.01.2026, the present writ petition is filed.
2. Heard Sri K.Naga Phanindra, learned counsel for the petitioner and Sri Appasani Vineeth, learned Assistant Government Pleader for Civil Supplies.

Learned counsel for the petitioner while reiterating the contents of the writ affidavit would contend that when the petitioner’s authorization in respect of fair price shop No.1382123 situated in Kurnool Urban, Kurnool District, has been suspended vide proceedings dated 31.10.2025, petitioner approached this Court by way of W.P.No.30942 of 2025 and this Court disposed of the same directing the respondents to complete the enquiry within a period of 90 days from the date of issuance of the impugned order failing which the suspension order dated 31.10.2025 would automatically be set aside. He further submitted that despite such direction, the respondents did not conclude the enquiry nor revoked the suspension order dated 31.10.2025. He further submitted that the authorities cannot suspend the authorization of the petitioner for an indefinite period, therefore, prayed to pass appropriate orders.

Sri Appasani Vineeth, learned Assistant Government Pleader, submitted that having questioned the same proceedings in one writ petition, the petitioner cannot file another writ petition impugning the very same proceedings. He further submitted that the petitioner approached this Court for the third time. In the said view of the matter, the writ petition being meritless, deserves dismissal, accordingly, prayed to dismiss the writ petition.
