Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased topleased to issue a writ, order or direction more particularly one in the nature of writ of Mandamus declaring the action of the respondent in illegally taking possession of my vehicle bearing No AP 31 BD 2116, by model Tata Safari LX, arctic white colour as illegal arbitrary and sheer abuse of power besides being violative of Criminal Procedure Code, 1973 and principles of natural Justice, consequently direct the 2nd respondent to handover the possession of the vehicle and to pay compensation for the wear and tear and loss caused due to the

high handed action of the 2nd respondent and to pass

ORDER:

This Writ Petition has been filed seeking to declare the action of

respondents in illegally taking possession of petitioner’s car bearing No.AP 31 BD 2116, as illegal and arbitrary and consequently direct 2^nd respondent to handover the possession of car and to pay compensation to the

petitioner.

2. Learned counsel for the petitioner submits that cause in the present

Writ Petition does not survive and the matter has become infructuous.

3. Recording the said submission, the Writ Petition is dismissed as

infructuous. No order as to costs.

4. As a sequel thereto, the miscellaneous applications, if any, pending in

this Writ Petition shall stand closed.
