Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a writ, order or direction more particularly one in the nature of writ of Mandamus declaring the impugned action of the respondents in not providing employment under land looser category either in the post JPA notified in Notification No. 01/CGM(HR)/2010, dated 05-01-2011, and supplementary Notification No. 01/CGM(HR)/2011, dated 17-10-2011 or Firemen notified in Notification No. 01/JS(Per)/2013, dated 22-04-2013 though petitioner found eligible as highly illegal, arbitrary and violative of Article 14 and 16 of the Constitution of India and to pass.

IA NO: 1 OF 2014(WPMP 17727 OF 2014 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the respondents to consider the petitioner for employment under land looser category in any of existing vacancies in RTPP for the post of JPA notified in Notification dt. 05-01-2011 and supplementary Notification dt. 17- 10-2011 or in the post of Firemen notified in Notification No. 01/JS(Per)/2013, dt. 22-04-2013 pending disposal of the above writ petition and to pass.

Order:-

The petitioner is seeking a direction from this Court to the respondents to accommodate him as Junior Plant Attendant under the land loser category.

2. The petitioner claims that the land belonging to him was taken over for the construction of the Rayalaseema Thermal Power Project and that the respondents had issued a notification for filling up the posts of Junior Plant Attendants. 50% of the vacancies were earmarked to be filled up with land losers whose lands were acquired for the construction of the project.

3. The learned Standing Counsel appearing for the respondents submits that one of the similarly placed petitioners had approached this Court by filing W.P. No. 24319 of 2018, and the learned Single Judge of this Court had disposed of the writ petition directing the respondents to consider the case of the petitioners therein in pursuance of G.O.Ms. No. 98. The 1^st petitioner in the said writ petition filed W.A. No. 908 of 2023, which was dismissed by the Hon’ble Division Bench of this Court.

4. Considering the judgment of the Hon’ble Division Bench of this Court in W.A. No. 908 of 2023, the petitioner has applied for the post of Fireman, and it is submitted that he has not passed the technical examination. Be that as it may, the respondent-Corporation shall consider the candidature of the petitioner for any suitable post under the land loser category.

5. With this observation, this writ petition is disposed of. There shall be no order as to costs.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
