GP FOR HOME The Court made the following:
ORDER
The Writ Petition has been filed under Article 226 of the Constitution of
India seeking the following relief:-
“…to issue an order or direction more particularly one in the nature of writ of mandamus declaring the inaction of the respondents particularly the 2nd and 3rd respondents in considering petitioners representation dt.25.3.2026 in providing the police Protection to the petitioners and his family members from the threatening of respondents No 4 and 5 by investigating on the complaint and registering the FIR is arbitrary illegal and against to the provisions Article 21 of the Constitution of India and consequently direct the respondents to provide police protection by duly registering the FIR against the 4th and 5th respondent by considering the
representation dt 25.3.2026 of the petitioners and to pass….”
2. Heard the learned counsel for the petitioners and the learned Assistant
Government Pleader.

Sri Andapalli Sanjeev Kumar, learned counsel for the petitioners, submits that there is inaction on the part of respondent Nos.2 and 3 in considering the petitioners’ representation dated 25.03.2026, seeking police protection to the petitioner and his family members from the threats allegedly made by respondent Nos.4 and 5, by investigating the complaint after
registering an FIR.

4. Sri P. Ajay Babu, learned Assistant Government Pleader, on written instructions, submits that the respondent police have conducted a preliminary enquiry and noticed that the entire nature of the transactions is civil/commercial and that no cognizable offences have been made out.
Therefore, the police have not taken any action.
5. Be that as it may, the petitioners have an alternative efficacious remedy by filing a private complaint before the learned jurisdictional Magistrate under Section 190 read with Section 200 of ‘the Cr.P.C.,’/Section 210 read with Section 223 of ‘the BNSS’, in case the representation of the petitioners are not
registered as FIRs.
6. Considering the entire facts and circumstances of the case, and recording the submissions of the learned Assistant Government Pleader, the Writ Petition is disposed of, requiring the petitioners to approach the learned jurisdictional Magistrate by way of filing an appropriate complaint under Section 190 read with Section 200 of ‘the Cr.P.C.,’/Section 210 read with
Section 223 of ‘the BNSS’, if so advised.
7. With the above observations and directions, the Writ Petition is
disposed of. There shall be no order as to costs.
As a sequel, Miscellaneous petitions, if any pending, shall stand closed.
