A writ petition is dismissed as infructuous when the petitioner dies and the cause of action does not survive for further adjudication.

Headnote:The petitioner filed a writ petition under Article 226 of the Constitution of India challenging the order of removal from service dated 15.03.2022 and a subsequent appellate order dated 23.09.2022. During the hearing, it was submitted that the petitioner had passed away. The court considered whether the cause of action survived. It was observed that since the petitioner died, the cause in the present Writ Petition does not survive for further adjudication and the matter becomes infructuous. The Writ Petition is dismissed as infructuous.

Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a writ, order or direction more particularly one in the nature of writ of Certiorari to call for the records pertaining to the order of removal from service dated 15.3.2022 in C.No.11957/H1/2021 by the 41h Respondent and a consequential order passed in Appeal rejecting the claim of the Petitioner dated 23.9.2022 in Rc.No.163/HGs.Estt/ 2020-2 by the 211d Respondent and set aside the same with all consequential service benefits and to pass

Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the Respondents herein to reinstate the Petitioner in to service as Home Guard by suspending the order of the 4th Respondent dated 15.3.2022 and consequential order dated 23.9.2022 passed by the 2nd Respondent pending disposal of the above Writ Petition and to pass

3. Recording the said submission, the Writ Petition is dismissed as infructuous. There shall be no order as to costs.

As a sequel, miscellaneous petitions, if any, pending shall stand closed.
