The Court made the following:

THE HONOURABLE SRI JUSTICE MAHESWARA RAO KUNCHEAM WRIT PETITION NO:15733 of 2016 ORDER:-

The instant writ petition, under Article 226 of Constitution of India, has been filed seeking the following main prayer:

“….to issue a Writ of Mandamus or any other appropriate Writ or Writs Order or Direction declaring the action of Respondents in not granting permission to the petitioner for decasting of sand from her patta land admeasuring Ac.7.17 cents in Sy.No.6 of Katavaram Village Sithanagaram Mandal East Godavari District as illegal and arbitrary and to consequently direct the Respondents to forthwith consider the representation made by petitioner on 25.4.2016 and grant all permissions to the petitioner for decasting of sand from her above patta land, in view of new sand policy framed by first respondent vide Memo No.3066/MII (1)/2016-7 dt 22.3.2016; Award costs and pass”.

2. Today, there is no representation on behalf of the petitioner.

The main grievance as stated in the Writ Affidavit is that the petitioner challenges the action of the respondent authorities in not granting permission for de-casting of sand from her patta land admeasuring Ac.7.17 cents in Sy.No.6 of Katavaram Village, Sithanagarama Mandal of East Godavari District and she also asserted that the respondent authorities are acting contrary to the new sand policy issued by the 1st respondent vide memo No.3066/M-II(1)/2016-7, dated 22.03.2016.

Per contra, the learned Assistant Government Pleader for Mines and Geology would submit that the present writ petition was instituted in the year 2016 seeking implementation of the sand policy at that relevant point of time i.e., 22.03.2016. But, in view of efflux of time, the sand policy was changed from time to time and presently, the Government of Andhra Pradesh has issued a comprehensive G.O.No.100 dated 26.06.2025 wherein all procedural aspects relating to sand policy was incorporated.

5. As stated supra, there is no representation for the petitioner and moreover the prayer in the writ petition has become redundant in view of efflux of time.

6. Hence, taking into consideration of all the facts and circumstances and coupled with specific assertions of the learned Assistant Government Pleader for Mines and Geology, the Writ Petition is closed by granting liberty to the petitioner to work out her legal remedies in accordance with law.

7. Accordingly, the Writ Petition is closed accordingly. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, pending if any, shall stand closed.
