Petition under Article 226 of the Constitution of India praying that

in the circumstances stated in the affidavit filed therewith, the High

Court may be pleased toto issue a Writ order or Direction more

particularly one in the nature of Writ of Mandamus, declaring the action

of the respondents rejecting for issuance of SC certificate pursuance

to the petitioners applications and the impugned endorsements

CGC011610294199, dated: 16.11.2016 by the 3rd respondent herein

without issuing the SC certificate i.e. "MadasiKuruva" to the

petitioners, as per the AP(SC, ST and BCs) Regulation of Issue of

Community Certificates Act, 1993 and Rules, 1997 (G.O.Ms.58 Social

Welfare(J), dated: 12.05.1997) as the same is notified as the petitioner

caste belong to "MadasiKuruva" Community notified as Category

No.31 of Schedule (PART-I), as illegal and arbitrary and consequently

direct the respondent authorities herein forthwith issue the SC caste

certificates to petitioners as mentioned as "MadasiKuruva" community

as per the AP (SC, ST and BCs) Regulation of Issue of Community

Certificates Act, 1993 and Rules, 1997 (G.O.Ms.58 Social Welfare(J),

dt12.05.1997), same is notified as the petitioners caste belong to

"MadasiKuruva" Community notified as Category No.31 of Schedule

(PART-I),

Petition under Section 151 CPC praying that in the

circumstances stated in the affidavit filed in support of the petition, the

High Court may be pleased to direct the 2nd and 3rd respondents

herein forthwith issue the SC caste certificate to the petitioners by

WRIT PETITION No.46453 OF 2016

O R D E R:

The present Writ Petition is filed questioning the „Endorsement,

dated 16.11.2016‟ of the Respondent No. 3 in rejecting the Community

Certificate of the Petitioners as „Madasi Kuruva‟ as illegal and arbitrary

and set aside the Endorsement as contrary to the provisions of A.P.

(SC, ST, and BCs) Regulation of Issue of Community Certificates Act,

1993 (for short, ‘the Act, 1993’).

2. The Petitioners had applied for Community Certificate as

„Madasi Kuruva‟ under the provisions of the said Act. The said

applications were rejected with an endorsement dated 16.11.2016,

“The applicant has not submitted relevant records” and no
