HIGH COURT OF ANDHRA PRADESH
K SREENIVASA REDDY
Vinnakota Vara Prasad – Appellant
Versus
The Union of India – Respondent
WP 7031/2025

2026:APHC:8228 APHC010134342025 IN THE HIGH COURT OF ANDHRA PRADESH AT AMARAVATI [3327]

(Special Original Jurisdiction)

TUESDAY, THE SEVENTEENTH DAY OF FEBRUARY TWO THOUSAND AND TWENTY SIX PRESENT THE HONOURABLE SRI JUSTICE K SREENIVASA REDDY WRIT PETITION NO.7031 OF 2025 Between:

Vinnakota Vara Prasad ...PETITIONER AND The Union of India and another ...RESPONDENTS Counsel for the Petitioner: 1. PANGULURU RACHANA Counsel for the Respondents:

1. BACHINA HANUMANTHA RAO (CENTRAL GOVT COUNSEL)

2. VENKATA RAMA RAO KOTA The Court made the following ORDER:

The present Writ Petition has been filed seeking to declare the action of 2nd respondent Bank in not releasing the original document i.e., House Patta issued in favour of the petitioner in spite of closure of loan account bearing No.662119940938, as illegal and arbitrary and consequently direct 2nd respondent Bank to return his original document kept in their possession forthwith.

2. Learned counsel for the petitioner submits that though the entire loan amount was cleared by the petitioner and loan account was closed on 19.01.2024, 2nd respondent Bank is not returning the original House Patta to the petitioner and surprisingly, at last, they informed that the petitioner has not produced any House Patta at the time of obtaining the loan. In support of his contention that the petitioner has cleared the loan amount on 19.01.2024, he filed copy of Bank Statement (Ex.P4).

3. On the other hand, learned counsel appearing on behalf of 2nd respondent Bank submitted that the account of the petitioner became Non-Performing Asset (NPA) for the period from ten (10) years, as the loan installments have not been cleared by the petitioner.

4. Be that as it may, since it is the case of the petitioner that he has cleared the loan amount and the loan account was closed on 19.01.2024, without going into the merits of the case, petitioner is permitted to make a representation before the respondent authorities for return of his original House Patta within a period of two (2) weeks from the date of receipt of a copy of this order, and on making such representation, the respondent authorities are directed to dispose of the same, in accordance with law, within a period of four (4) weeks therefrom. It is made clear that whether the respondent authorities are holding the House Patta of the petitioner or not also would be stated in the order to be passed by them.

5. With the above directions, the Writ Petition is disposed of.

There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
