O R DE R:

The Writ Petition is filed questioning the rejection of the claim of the Petitioners for sanction and disbursement of Post Matric Scholarship to the Schedule Caste, Schedule Tribe and Backward Class Students vide Proceedings dated 12.08.2013 in pursuance of G.O.Ms.No.66, dated 08.09.2010, as illegal and arbitrary.

The Petitioners were admitted to Respondent No. 10 Minority Educational Institution under the 80% Convener Quota and claimed to be entitled to fee reimbursement as the Petitioners belong to the BC, S.C., and S.T. and physically challenged categories. Vide impugned Order dated 12.08.2013, the Respondent Authorities had rejected the claim of the Petitioners on the ground that to avail the benefit of Post Matric Scholarship as provided under G.O.Ms.No.66 SW (SW.Edn.2) Department, dated 08.09.2012, the students must have enclosed CET Allotment Orders and uploaded the same to the e-pass website for sanction of scholarship. It is stated that among the Petitioners, 9 B.C. and 5 E.B.C. students have not submitted the CET Allotment Orders, and as the Petitioners have not submitted the required documents for sanction of scholarship, their applications were rejected. Questioning the same, the present Writ Petition is filed.

The Learned Assistant Government Pleader submits that as per G.O.Ms.No.66 SW (SW.Edn.2) Department, dated 08.09.2012, the students admitted by the Convener as notified by the Government under the Quota meant for the Convener shall be eligible for the PMS scheme, and the students admitted under the Management Quota or through Spot Admissions, i.e., leftover seats of the Convenor, will not be eligible for the PMS Scheme.

4. Heard the respective counsel.

5. In the present case, the Petitioners claim to be admitted under the 80% Convener Quota, CET Allotment Orders were not included to substantiate their claim. The eligibility for Convener Quota Seats reads as under:

Eligibility for Convener Quota Seats: All students admitted by the Convenor as notified by the Government, under the Auota meant for the Convenor, shall be eligible for the PMS scheme. However, students admitted under management quota or through spot admissions i.e., left over seats of the Convenor quota filled by managements subsequently, will not be eligible for the PMS scheme. In respect of Medical Colleges, the PMS scheme will also be applicable to the “B” category only in respect of Succession Certificate and ST students”.

6. In the absence of proof of admission under the Convener quota, the rejection of the claim by the Respondent Authorities under the impugned Orders cannot be faulted. Therefore, the present Writ Petition is devoid of merit.

7. Accordingly, the Writ Petition is dismissed. There shall be no order as to costs.

As a sequel, the miscellaneous petitions, if any, pending in this Petition shall stand closed.
