ORDER

The Writ Petition has been filed under Article 226 of the Constitution of India seeking the following relief:-

“…to issue an appropriate Writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondent police in not registering F.I.R. on the report of the petitioner dated 08-09-2025 and proceed with investigation in accordance with law as illegal, arbitrary, unconstitutional, and violative of Articles 14, 21 and 300-A of the Constitution of India and consequently direct the 4^th respondent to register the report of the petitioner dated 08-09-2025 against the named accused in the interest of justice and be pleased to pass….”

2. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Home.

3. Sri Sravan Kumar Naidana, learned counsel for the petitioner, submits that the complaint dated 08.09.2025 submitted by the petitioner to the respondent Nos.3 and 4 has not been registered.

4. Sri P. Ajay Babu, learned Assistant Government Pleader, on written instructions, submits that after conducting a preliminary enquiry as contemplated under Section 173(3) of ‘the BNSS’, respondent No.4 found that the dispute is purely civil in nature and, therefore, could not proceed further with the complaint.

5. Recording the above submission, the Writ Petition is disposed of granting liberty to the petitioner to work out his alternative and efficacious remedy before the learned jurisdictional Magistrate by way of filing a complaint under Section 190 read with Section 200 of ‘the Cr.P.C.,’/Section

210 read with Section 223 of ‘the BNSS’.

6. In the result, the Writ Petition is disposed of. There shall be no order as to costs.

As a sequel, Miscellaneous petitions, if any pending, shall stand closed.
