THE HONOURABLE SRI JUSTICE D.RAMESH WRIT PETITION No.34015 of 2025

ORDER:

This writ petition is filed seeking the following relief:

“….to issue an order, writ or direction, more particularly one in the nature of WRIT OF MANDAMUS declaring the action of the Respondents in not considering the Petitioner for selection and appointment to the post of Secondary Grade Teacher (SGT) in Mega DSC-2025, despite her eligibility under their respective reserved category, and in wrongly adjusting Open Category candidates into reserved quota posts and in violating G.O.Ms.No.77,dated 02.08.2023, the Presidential Order 1975, and the Rules relating to Local and Non-Local quota under A.P. State and Subordinate Service Rules as illegal, arbitrary, and in violation of the principles of natural justice, as well as violative of Articles 14, 19(1)(g), and 21 of the Constitution of India. Consequently, direct the respondents to revise the merit list of Mega DSC-2025 in accordance with law, by properly applying the rules of reservation, roster principles, and the Local and non-local quota, and to appoint the Petitioner in the posts earmarked for her rightful reservation categories, treat the Petitioner as an eligible candidate and include her name in the final selection list in accordance with her merit and eligibility, conduct certificate verification for the Petitioner and permit them to participate in all consequential stages of the recruitment process, consider the Petitioner for selection and appointment in DSC-2025 in accordance with law….”

2. Heard the learned counsel for the petitioner and the learned Government Pleader appearing for the respondents.

3. The contention of the learned counsel for the petitioner is that the respondents have not strictly followed the rule of reservation in accordance with G.O.Ms.No.77, dated 02.08.2023. The respondents have considered the candidate at rank No.54 to the post of Secondary Grade Teacher (SGT) under the BC-C category in the Municipal Corporation. It is further contended that if the respondents have considered the candidate at rank No.54 under the open category based on merit, the petitioner would have secured accommodation and selection under the OC-C category.

In reply to the said contentions, the learned Government Pleader appearing on behalf of the respondents submitted that in the Municipal Corporation, the last selected candidate under the open category was rank No.24. As far as the BC category is concerned, the candidate, who secured the highest rank in that category, was accommodated as per her option. Hence, the respondents have strictly followed the rule of reservation as stipulated in G.O.Ms.No.77.

5. Considering the said submissions, there are no merits in the writ petition.

6. Accordingly, the Writ Petition is closed. There shall be no order as to costs.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
