IN THE HIGH COURT OF ANDHRA PRADESH AT AMARAVATI
Subhendu Samanta, J
A.Selvam – Appellant
Versus
The State of A.P. – Respondent
CRIMINAL REVISION CASE No:53 OF 2014

Advocates:
For the Appellants/Petitioners: T Lakshmi Padmaja
For the Respondents: Kondeti Ranga Srinivas, Public Prosecutor (AP)

The High Court can exercise its inherent powers under Section 482 Cr.P.C. to compound non-compoundable offences and set aside convictions in non-heinous, private disputes where parties have amicably settled, to secure the ends of justice and maintain social harmony.

Headnote:The petitioner was convicted under Section 324 of the Indian Penal Code, 1860, by the Trial Court, a decision subsequently upheld by the appellate court. The petitioner filed a criminal revision and later sought to compound the offence based on an amicable settlement reached with the de facto complainants, as evidenced by a joint memo of compromise. The primary issue was whether the High Court could compound an offence that is non-compoundable under Section 320 of the Code of Criminal Procedure. The court reasoned that while Section 320 is restrictive, the inherent powers of the High Court under Section 482 of the Code of Criminal Procedure allow for the quashing of proceedings or setting aside of convictions in non-heinous, private disputes where a settlement is reached to secure the ends of justice and maintain social harmony. Therefore, the impugned order of conviction recorded by the Judicial Magistrate of First Class Court, Sathyavedu, in C.C. No.21 of 2009 and confirmed by the III Additional Sessions Judge, Tirupati, in Crl.A.No.249 of 2012, is hereby set aside in terms of the compromise between the parties.
