Petition under Article 226 of the Constitution of India praying that in the
circumstances stated in the affidavit filed therewith, the High Court may be
pleased toto issue a writ of mandamus or any other appropriate writ or
direction declaring the impugned order passed by the 5th respondent vide
Proceedings No. 03/2017 dated 17.05.2017, terminating the service of the
petitioner from the post of Anganwadi worker of Vastrapuri Colony, Anganwadi
Centre, Code No. 85, ICDS Rajam, Srikakulam District is arbitrary, illegal,

against principles of natural justice and without jurisdiction and consequently
set aside the same

The court made the following ORDER
The writ petition is filed under Article 226 of the Constitution of India,
seeking the following main prayer:
“…..declaring the impugned order passed by the 5th
respondent vide Proceedings No. 03/2017 dated 17.05.2017,
terminating the service of the petitioner from the post of
Anganwadi worker of Vastrapuri Colony, Anganwadi Centre,
Code No. 85, ICDS Rajam, Srikakulam District is arbitrary,
illegal, against principles of natural justice and without
jurisdiction and consequently set aside the same…..”
2. The substratum of the writ petition is that the petitioner challenged
termination proceedings dated 17.05.2017 issued by the 5th respondent
without complying the principles of natural justice.
3. At the time of considering the matter, learned counsel for the petitioner
submits that by virtue of interim orders dated 29.06.2017 passed by this Court,
the petitioner was re-engaged to the post of Anganwadi Worker at Vastrapuri
Colony, Anganwadi Centre, Code No.85, ICDS Rajam, Srikakulam District. In
view of same, he submits that no further orders are required in the present writ
petition.
4. Learned Assistant Government Pleader for Social Welfare is present.

5. Recording the above submission made by the learned counsel for the
petitioner that the petitioner was re-engaged into service, the writ petition is
closed.
6. There shall be no order as to costs. As a sequel, all pending
applications shall stand closed.
